Jakarta. A legal rights group has lashed out at what it called a baseless decision by a senior government minister to press ahead with the development of one of the artificial islands that form part of the North Jakarta reclamation project.

Coordinating Maritime Affairs Minister Luhut Binsar Pandjaitan decided on Tuesday (13/09) to lift the suspension imposed by his predecessor Rizal Ramli in June on the development over environmental and legal concerns.

Luhut played down a court verdict that annulled a gubernatorial decree on the development of Island G, following a complaint by a group of local fishermen.

“The issuance of the permit for the island development did not involve the community,” Tigor Hutapea of the Jakarta Legal Aid Institute (LBH) said, citing the court verdict.

Defending his decision, Luhut said: “It doesn’t matter. The court verdict has not been legally binding yet.”

Tigor called Luhut’s statement “careless,” adding that “the legal basis for the island development has also violated the law in the first place.”

He was referring to the 2007 Law on the Management of Coastal Areas and Islets, which includes provisions on plans for zoning in such areas. This also applies to the North Jakarta reclamation project.

City councilors have suspended deliberation on draft bylaws related to the matter following allegations of graft, with several leaders of the reclamation developers having been implicated.
